Emily's story

Emily * was a primary school student. She put a pebble in her ear which became stuck. She was seen at a Hospital Emergency Department where two doctors attempted to remove the pebble but in doing so pushed it further into the ear cavity and caused a rupture of her eardrum. Emily * was rendered deaf in one ear. The effect on her earning capacity in later years was unclear due to her young age and her parents incurred medical expenses on her behalf. Maddens Lawyers sued the Hospital in the Supreme Court. The claim was denied. The matter settled at mediation for $200,000.00, a settlement approved by the Court. The funds remain invested on Emily’s* behalf until she turns 18 by which time interest payable will have substantially increased the amount of money payable to her.
